The purpose of Missoni S.p.A. (“Missoni” or the “Seller”) is to ensure that you are fully satisfied. If for any reason you are not satisfied with your order, you may exercise your right of withdrawal, without any penalty, within fourteen (14) days of the day of delivery of the products purchased from the Site or, if you selected the “Collect from Store” option at the time of purchase, within fourteen (14) days of the date of collection of the order at the selected Missoni store.  

The right of withdrawal may be exercised, alternatively: 

  1. by filling in the “Return Form” (conforming to the model form pursuant to Article 49, paragraph 4, of the Italian Consumer Code) available at the following link: Return Form or found online in the Customer Service area; or 
  2. by telephoning the Customer Service and activating the relevant procedure, as described below, which provides for the Seller sending a Withdrawal Confirmation Email. 

The Seller will send you confirmation by email that it has received the withdrawal request sent via the “Return Form” or via a telephone call to Customer Service (the “Withdrawal Confirmation Email”). 

The products to be returned must be handed to the courier within fourteen (14) days of the date on which you informed the Seller of your decision to withdraw from the contract in accordance with the methods and procedures described above. The products may be returned by forwarding the package via the courier indicated by the Seller (DHL), or via another carrier.  

In the event that you decide to use a carrier other than the one indicated by the Seller (DHL) for the return of the products, you will conversely have to pay the necessary costs personally and will remain liable for any loss of or damage to the products during transport. 

Conversely, it is not possible to exchange the garment chosen for another item. 

1. CONDITIONS FOR EXERCISING THE RIGHT OF WITHDRAWAL

The right of withdrawal shall be deemed to have been properly exercised if the following conditions are fully met: 

  1. the “Return Form” is sent directly online through the Site or the Customer Service has been contacted and the procedure explained by them has been followed, within fourteen (14) days of receipt of the products or, if you selected the “Collect from Store” option at the time of purchase, of the date of actual collection of the order from a Missoni store; 
  2. the products must not have been used, worn, washed and must necessarily comply with the requirements described in the Conformity Checks section below; 
  3. the identification tag must still be attached to the products with the disposable seal forming an integral part of the goods; 
  4. the products must be returned in their original packaging; 
  5. the returned products must be handed to the carrier within fourteen (14) days of when you informed the Seller of your decision to withdraw from the contract and received the Withdrawal Confirmation Email; and 
  6. the products must not be damaged. 

If you have complied with all the required conditions, the Seller will refund the price of the purchased products in full. If you decide to use the courier chosen by the Seller for the shipment of the purchased products (DHL), you will not, however, have to pay the return delivery costs yourself, as the Seller will pay the DHL courier on your behalf, deducting from your refund an amount equal to the cost previously incurred for the delivery of the purchased products to your home.  

In the event that you decide to use a carrier other than the one indicated by the Seller (DHL) for the return of the products, you will conversely have to pay the necessary costs personally and will remain liable for any loss of or damage to the products during transport. 

You will be contacted if your return cannot be accepted because it does not comply with the conditions in a) and e) in the preceding paragraph. In this case, you can choose to have the purchased products back at your own expense. Should you refuse this delivery, the Seller reserves the right to retain the products and the amount corresponding to the purchase price of the products. 

Fragrances and socks are not returnable.  

The Seller reserves the right to designate other products on the site as “non-returnable”. This will be stated in the details on the page concerning the non-returnable product. 

2. CONFORMITY CHECKS

Our products must be returned unused and new, in perfect condition and complete with all protective materials, with any labels and tags attached and including all required accessories and documents. If the product shows signs of wear and tear or has been used or altered in any way compared to its original condition, we reserve the right not to accept the return or, alternatively, to reduce the amount of the refund or exchange. 

For example, we may reduce the refund in the following circumstances: 

  1. the product(s) have been used, worn, damaged or washed; 
  2. the identification tag with the disposable seal is not attached to the product(s) or has not been returned. Please note that the identification tag is an integral part of each product; and/or 
  3. you have not returned the packaging that is an integral part of the product (e.g. the dust bag). 

If it is necessary to reduce your refund for any of these reasons, we will inform you by email. In this case, you may (as an alternative to a reduced refund) choose to have the products sent back to you at your own expense. If you refuse this option, Missoni reserves the right to retain the products and the amount indicated for the reduction of the refund on account of the reduced value of the returned products. 

Should you refuse this delivery, the Seller reserves the right to retain the products and the amount indicated for the deduction of the refund due to the diminished value of the returned products. 


3. TIMEFRAME AND PROCEDURES FOR REFUNDS

After the Seller has received your return and checked that all requirements have been met, you will receive an email confirming acceptance of the return, or, if the returned products have incurred a noticeable reduction in value, you will receive an email informing you of the amount deducted as a deduction from your refund. Whatever the payment method used by you, the full or partial refund shall be initiated by the Seller in the shortest possible time and in any case – after verifying that the withdrawal took place in full compliance with the conditions set out in the General Terms and Conditions of Sale and in the Right of Withdrawal Policy – within fourteen (14) days of the date on which the Seller became aware of you exercising the right of withdrawal, provided that it has already received the returned products or been provided with proof by you that the products have already been dispatched (whichever is the sooner) and may, until then, retain the refund. 

 

The actual time for crediting or returning the sums paid by you for the purchase of the products depends on the payment method used: 

 

  1. credit/debit card purchase: the refund time depends on the credit/debit card company, but normally the refund will take place within the time required for issuance of two account statements. We would remind you that the value date of the re-credit payment is the same as that of the debit; consequently, you will not incur any loss in terms of bank interest. 
  2. purchase via PayPal (if available): the refund will be made to your PayPal account and will be visible immediately. The actual refund to the credit card from your PayPal account depends on the bank that issued the card. 


4. PRODUCT IDENTIFICATION TAG

All products offered for sale by the Seller have an identification tag attached with a disposable seal, which is an integral part of the goods. We strongly recommend that you try on the product without removing the tag and seal, as any returned products lacking these will not be accepted. 

5. SELLER’S CARRIER

Returns can be sent via the courier indicated by the Seller (DHL), using the pre-printed adhesive label you will find inside your parcel. This method will enable the Seller to pay for the delivery on your behalf and to check where your parcel is at any time. Contact DHL to arrange for collection. In the event that you decide to use a carrier other than the one indicated by the Seller for the return of the products, you will have to pay the necessary costs for the return personally and will remain liable for any loss of or damage to the products during transport. 

6. CONSUMER CODE

These Terms and Conditions for the Exercise of the Right of Withdrawal, which form an integral part of the General Terms and Conditions of Sale, are governed by Italian law and in particular by Legislative Decree No. 206 of 6 September 2005 (the Italian Consumer Code), as amended from time to time.
